User Agreement
Effective date: 5 November 2026
This Agreement sets out the terms and conditions of the PHOTOHUNTER digital photography service for buyers and photographers.
1.
Who you are entering into a contract with
PHOTOHUNTER is operated by two operators. Who exactly you are entering into a contract with depends on the country where the photograph was taken (the ‘shooting market’), rather than on the language of the website or your place of residence:
- Shootings in Ukraine:
Individual entrepreneur Alla Adolfivna Yukhimovich, EDRPOU code 2163025926, 57 Mykola Zakrevskyi Street, flat 113, Ukraine. Telephone: +380965307891, email: [email protected]. Prices are quoted in Ukrainian hryvnias; payments are processed via LiqPay.
- Photography in all other countries:
NAZAR BOHUN CONSULTING LLC DBA PHOTOHUNTER, a limited liability company registered in the State of Massachusetts (USA), 410 Washington St, Unit 103, Dedham, MA 02026, United States. Telephone: +1 (978) 339-9464, email: [email protected]. Payments are processed via Stripe.
The transaction operator is specified during the checkout process and in your order. A basket containing photographs from shoots in different markets is split into separate orders, each with its own transaction operator. For photographers, the transaction operator is the market operator for each shoot they upload.
In this Agreement, ‘PHOTOHUNTER’, ‘we’ and ‘us’ refer to the operator applicable to you as set out above.
2.
Digital photographs
PHOTOHUNTER offers digital photographs via electronic delivery.
The files purchased for download are the original files uploaded by the photographer, in the same format and resolution in which they were uploaded. The file format and resolution may vary depending on the photograph.
Your photographs will become available on the order page once payment has been confirmed and the order has been processed. You can download the photographs individually or all together in a ZIP archive. We will also send you an email containing a link to your order page. See the document Payment and Delivery
.
Purchased photos can be downloaded within 14 calendar days of purchase. Please download your files within this timeframe.
Posters (Ukraine only).
For photos taken in Ukraine, you can also order a printed poster from your purchased photograph. Posters are produced by a printing house and delivered by Nova Poshta; the price, delivery terms and times are specified before payment and described in the document Payment and Delivery
.
Copyright and PHOTOHUNTER’s authorisation to provide the service
. Copyright in the photograph remains with the photographer or other lawful copyright owner. Uploading or purchasing a photograph does not transfer ownership of the copyright to either PHOTOHUNTER or the buyer.
By uploading a photograph, you grant PHOTOHUNTER a non-exclusive licence to publish, display and deliver that photograph to the extent necessary for the operation of the service for the sale and uploading of photographs. This licence does not grant the right to use the photograph separately in PHOTOHUNTER’s advertising.
Licence to the purchaser for personal use
When you purchase a photograph, PHOTOHUNTER, on behalf of the lawful copyright holder, grants you permission to download and save it, print it for personal use, and share it on your personal social media accounts. Advertising, resale and other commercial use require separate permission from the copyright holder or an authorised licensor. The purchase itself does not imply consent from the people depicted in the photograph for such use, which requires their consent.
By offering a photograph for sale, you authorise PHOTOHUNTER to grant buyers the permission for personal use described above on behalf of the lawful copyright holder. You must possess the rights or authority necessary to grant PHOTOHUNTER such permission. This authorisation does not transfer copyright and does not permit PHOTOHUNTER to grant rights for promotional, resale or other commercial use.
Your permission for personal use of the purchased photograph remains valid even after the upload period has ended or your account has been closed. This does not extend the period during which PHOTOHUNTER stores the photograph or makes it available for download.
Photographer’s responsibility to obtain consent
Photographers are responsible for obtaining consent from people who can be recognised or otherwise identified in a photograph before uploading and offering their photographs via PHOTOHUNTER. Such consent must cover the intended uploading, display, sale and delivery via the service. In the case of a person under the age of 18, the photographer must obtain consent from a parent or legal guardian.
Photographers must obtain written consent in all cases where this is required by applicable law. Verbal consent does not replace the written consent required by law. Permission to take a photograph does not, in itself, constitute permission for any subsequent use.
Separate permission for PHOTOHUNTER promotion
At present, PHOTOHUNTER does not use customers’ photographs in its own advertising, promotional images on the homepage or promotional posts on social media.
PHOTOHUNTER will use photographs uploaded to the service in its own advertising, promotional images on the homepage or promotional posts on social media only with the separate written consent of the copyright holder and each person in the photograph who is recognisable or otherwise identifiable. In the case of persons under the age of 18, permission must be granted by a parent or legal guardian. Uploading or purchasing a photograph does not, in itself, constitute such permission for promotional use.
Reporting a photograph uploaded without permission
If your photograph — or a photograph of a child of whom you are the father, mother or legal guardian — — has been uploaded without permission, please contact PHOTOHUNTER directly using the operator’s contact details in Section 1 and request that it be removed. You do not need a PHOTOHUNTER account or the photographer’s assistance to do this. PHOTOHUNTER will review your request and remove the specified photograph from the service, even if the photographer does not respond.
We will block access to the specified photograph within 24 hours of receiving sufficient information to identify it, including at weekends and on public holidays.
Age requirement for creating an account and making purchases
To create a PHOTOHUNTER account or make a purchase, you must be at least 18 years old. Purchases for a child under the age of 18 must be made by a parent or legal guardian.
3.
Buyer payments
Payments for photo shoots in Ukraine are processed via LiqPay; payments for photo shoots in other countries are processed via Stripe. Buyer payments are received by the photo shoot marketplace operator, who also makes payments to the photographers.
Prices are quoted in the currency of the shoot marketplace. The final amount and payment currency are displayed during the checkout process, before you confirm your purchase. International customers can make purchases via the website.
You can add a tip for the photographer to your purchase. Tips are paid and refunded alongside the purchase to which they are added, and are distributed in the same way as the sale of a photograph (section 4).
4.
Photographer’s earnings and platform commission
For each sale of a digital photograph, PHOTOHUNTER retains a platform commission of 20 per cent of the photograph’s sale price, excluding sales tax. The photographer’s share is 80 per cent of this price. Sales tax is not included in this breakdown. For posters, the photographer’s share is a percentage of the poster’s price, as specified in the photographer’s account for the relevant market.
PHOTOHUNTER pays the payment provider’s commission for processing the payment from its own share. The payment processing fee is not deducted separately from the photographer’s 80 per cent share.
For example, a photograph sold for $10 excluding sales tax earns the photographer a share of $8. PHOTOHUNTER deducts $2 and pays the payment processing fee from this amount.
If the proceeds from the sale of a photograph are refunded, 80% of the photographer’s earnings and PHOTOHUNTER’s 20% share from that sale are reversed. PHOTOHUNTER covers the payment processing fee, which is non-refundable. In the event of a refund for the sale of a photograph for $10 excluding tax, the photographer’s earnings are reduced by $8, and PHOTOHUNTER returns its $2 share.
If the photographer’s share of the refunded sale has already been paid out, PHOTOHUNTER will deduct this amount from the photographer’s future earnings. For the $10 sale mentioned above, the amount to be deducted from future earnings is $8.
5.
Withdrawals by photographers
Earnings are tracked separately for each currency and withdrawn separately.
Ukraine (hryvnia).
You can request a withdrawal to a Ukrainian bank card once your available earnings reach the minimum amount specified in your account. Each request is reviewed by the PHOTOHUNTER team, and once approved, the funds are transferred to your card via a payment provider.
Other countries.
You can submit a standard withdrawal request once your available earnings reach $300 USD — the minimum withdrawal amount. PHOTOHUNTER processes withdrawals within 5 working days of receiving a complete request with valid US bank details. This is a processing timeframe and does not guarantee that the recipient’s bank will credit the funds within this timeframe. Withdrawals are made via electronic bank transfer to bank accounts in the US. PHOTOHUNTER covers standard fees for sending bank transfers to the US, without deducting them from the requested withdrawal amount. For example, for a withdrawal of $300, PHOTOHUNTER sends $300 and pays the transfer fee separately. PHOTOHUNTER has no control over any fees charged independently by the recipient’s bank.
When a photographer closes their account, PHOTOHUNTER pays out any remaining positive balance of earnings after the relevant adjustments, even if this balance is less than the minimum amount.
6.
Refunds to buyers and cancellations
Please report any incorrect or damaged photo files, or any issues with downloading a purchased photo, within 14 calendar days of purchase. We will first attempt to resolve the issue or resend the photo. If we are unable to resolve the issue, we will refund the purchase in question. If you have been charged more than once for the same purchase, we will refund the duplicate charge.
If access to your purchased photos is delayed due to a delivery issue on PHOTOHUNTER’s part, the 14-day calendar period for reporting the issue begins from the moment the photos first become available to you. You can report a failure to deliver whilst you are still waiting. If you decide to download the photographs at a later date, this period does not restart.
We do not cancel purchases or issue refunds simply because you have changed your mind after purchasing a digital photograph, particularly before you have downloaded it. This does not limit the remedies described above in the event of problems or duplicate charges, nor does it affect your rights under applicable law.
We will review your request, attempt to resolve the issue with the file or the download, and, if the refund is approved, process the refund within 7 working days of receiving your request. We will process approved refunds without delay. Attempts to correct the photograph or resubmit it do not extend this seven-working-day period. If a problem with the file or upload, to which these terms apply, cannot be resolved within this period, we will refund the payment within the same timeframe.
Working days are Monday to Friday, excluding public holidays: in Ukraine, Ukrainian public holidays according to Kyiv time; in other countries, US federal holidays according to Eastern Time (ET). Refunds are issued via the original payment method through the payment provider used to make the purchase (LiqPay or Stripe). The buyer’s bank or payment provider may require additional time to credit the funds.
Nothing in these refund terms excludes or limits any consumer rights or remedies that cannot be lawfully excluded or limited. The standard 14-day period for reporting an issue does not affect these rights.
Please contact customer support using the operator’s contact details in Section 1. For the full refund terms and conditions, including those relating to posters, please see the document Warranties and Returns
.
